Syed Afzal Ahmed v. Vangala Sudhakar

THE HONOURABLE SRI JUSTICE RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT APPEAL NO.1148 OF 2018 ORDER: (per Hon'ble Sri Justice Raghvendra Singh Chauhan) Sri Syed Afzal Ahmed, appellant is aggrieved by the order dated 10.07.2018 passed by the learned Single Judge in W.P.No.5832 of 2015, whereby, the learned Single Judge, after having the consent of the parties, had remitted the case back to the Revenue Divisional Officer for his decision. He further directed the Revenue Divisional Officer to decide the case within a period of three months.

As mentioned above, the said impugned order was passed after all the parties had given their consent to remit the matter back to the Revenue Divisional Officer. Thus, obviously the impugned order is passed on the consent of the parties.

It is well settled principle of law that a consent order cannot be challenged in an appeal. Therefore, this appeal is hereby dismissed. Consequently, miscellaneous petitions pending, if any, shall also stand dismissed.
