The limited grievance of the petitioner in this writ petition is that though he is the owner and pattedar in Sy.No.34, 35 and 36 of Sulthanpur Village, Ameenpur Mandal but the same is included in the list of prohibited properties under Section 22-A of the Registration Act. Aggrieved by such inclusion, petitioner submitted a representation to the District Collector, Sanga Reddy District on 20.03.2017. According to the petitioner, a report was called for from the Revenue Divisional Officer (RDO) and in response the RDO submitted report also. According to learned counsel for the petitioner, the said report is in favour of the petitioner.

This Court is not inclined to express any opinion at this stage. Even according to the petitioner, the property claimed by the petitioner is included in the prohibited list of properties and petitioner filed application before the District Collector to exclude the property from the list of prohibited properties. 4.

Having regard to the above, the Writ Petition is disposed of directing the District Collector, Sanga Reddy District, to examine the claim of the petitioner as ventilated in his representation dated 20.03.2017 by duly taking note of the report of the subordinate authority, if any submitted and pass appropriate orders, as

- 3 - warranted by law, within a period of two (2) months from the date of receipt of copy of this order. It is needless to observe that if the District Collector agrees with the contention of the petitioner that the property is a private property and cannot be prohibited for alienation, suitable steps shall be taken to intimate the registering authority about exclusion of property from the list of prohibited properties list. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
