HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.6352 of 2008 IN CRL.P.M.P.No.11955 of 2015 IN CRL.P.M.P.No.11956 of 2015 ORDER:

Petitioner-accused filed this petition seeking quashing of the proceedings initiated against him in C.C.No.152 of 2003 on the file of the Court of the II-Additional Judicial Magistrate of First Class, Tirupathi, registered for the offence punishable under Section 420 I.P.C.

When this matter is taken up for hearing, it is brought to the notice of this Court by the learned Counsel for the petitioner as well as the learned Counsel for the 2nd respondent-complainant that the parties have entered into compromise at the instance of elders and to that effect they filed a joint compromise memo. The said joint compromise memo, which is signed by the parties and their Counsel, is accompanied by Crl.M.P.Nos.11955 and 11956 of 2015. Today, both the parties were present before this Court and they were identified by their respective Counsel. A perusal of the joint memo filed by the parties would show that the 2nd respondentcomplainant has settled the dispute with the petitioner-accused and has no objection to quash the proceedings initiated against the petitioner-accused.

In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and Crl.M.P.Nos.11955 and 11956 of 2015 are ordered. Further, the offence alleged against the petitioner-accused is compounded in

view of the decision of the apex Court in Yogendra Yadav and others v. the State of Jharkhan.

Accordingly, the Criminal Petition is allowed and the proceedings initiated against the petitioner-accused in C.C.No.152 of 2003 on the file of the II-Additional Judicial Magistrate of First Class, Tirupathi, are hereby quashed in terms of the compromise entered into between the parties.
