This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: "declaring the inaction of the 3rd respondent in taking action for digging of trench, raise the plantation and erect the gate around the burial ground situated at Peddakalavala Village, Peddapalli Mandal and District, in spite of the representation dt.6-01-2017 as being illegal, arbitrary and unjust and consequently direct the respondent Nos.2 and 3 herein to take immediate steps to dig the trench, raise the plantation and erect the gate around the burial ground."

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

The grievance of the petitioner is that he submitted a representation, dated 06.01.2017, to the 3rd respondent to take steps to erect fencing around the burial ground situated at Peddakalavala Village, Peddapalli District, but no action has been taken so far. On earlier occasion also he filed application before the Human Rights Commission seeking the self same relief. The Commission called for the report from the Tahsildar, who in turn submitted a report on 16.02.2016, saying that necessary action would be taken, but no action has been taken. 4.
In view of the facts and circumstances of the case, the 3rd respondent is directed to take action on the representation, dated 06.01.2017, of the petitioner, as expeditiously as possible.
With the above direction, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ____________________________ A.RAJASHEKER REDDY, J MARCH 27, 2017 YVL
