THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30535 of 2018 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Telangana).

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of Writ of Mandamus declaring the action of the third respondent in not issuing new E-Pattadar Pass Book and cheque under Rythubandu scheme in respect of the land in Survey Nos.29/ A and 29/ AA, situated at Yendlabatla village of Nagarkurnool Mandal, Nagarkurnool District, in the name of the petitioner, even though she is the absolute owner of the said property, as illegal and arbitrary.

The grievance of the petitioner appears to be that though she is the pattadar, the third respondent - Tahsildar is not issuing the pattadar pass book and withholding the same for reasons best known to him. According to the petitioner, she made an application before the Tahsildar on 25.05.2018, seeking issuance of pattadar pass book, but the same is not acted upon till date.

Learned Government Pleader would submit that probably pendency of a suit must have weighed with the Tahsildar in not issuing the pattadar pass book.

Be that as it may, the Writ Petition is disposed of directing the third respondent - Tahsildar to deal with the representation dated 25.05.2018, seeking issuance of pattadar pass book, in accordance with law, as early as possible, preferably within a period of ten (10) weeks from the date of receipt of a copy of the order. If he is not intending to issue the pass book, he shall communicate the same to the petitioner with a reasoned order. 7.
