This appeal is preferred under Section 173 of the Motor Vehicles Act, 1988 by the appellant/respondent No.2 challenging the judgment and award, dated 28.08.2009, passed in M.V.O.P.No.487 of 2007 on the file of the Chairman, Motor Accidents Claims Tribunal-cum-Principal District Judge, Kadapa. The learned counsel for the appellant has sought permission of this Court to permit the appellant to withdraw the appeal.

Permission is granted.

Hence, the Appeal is dismissed as withdrawn. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
