THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13778 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.2 seeking anticipatory bail in connection with Crime No.172 of 2025 of Kodad Rural Police Station, Suryapet District. The offences alleged against the petitioner are under Sections 137 (2), 62(2)(m) r/w.49 of Bharatiya Nyaya Sanhita, 2023 and under Section 5(1) r/w.6, 17 of the POCSO Act. 2.

The case of the prosecution is that the mother of victim lodged a report before police on 23.08.2025 stating that on 19.08.2025 after having dinner, her elder daughter along with other family members went to sleep in her house. On the next day morning she noticed her daughter missing. Immediately, she searched for her daughter in and around the village and despite their efforts they could not trace her whereabouts, and she expressed suspicion against one Devapangu Sachin and when they questioned one of the family members of Sachin, he informed that Sachin mobile phone is switched off and requested two days time to bring back her daughter and the

- 2 - younger paternal uncle of Sachin advised them not to lodge any report. However, despite the assurance, Sachin and his family members failed to bring back the daughter of complainant. Hence, complainant requested the police to take necessary action against the accused. Basing on the said complaint the police registered the case against the accused for the said offences. A.1 is the main accused in this case, having relationship with the victim girl and A.2 to A.4 are abettors. 3.

Heard Sri Rajashekhar Reddy Jejala, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. Except the allegation that petitioner arranged a room for the victim and A.1, there are no other allegations to constitute any of the offences alleged against the petitioner. A.3 and A.4 were already served with Section 35(3) of BNSS and the petitioner herein also stands on the same footing. As such, prayed this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the allegation against this

- 3 - petitioner is different from that of A.3 and A.4. There are serious allegations against this petitioner that he encouraged A.1 for commission of the said offence. As such, requested this Court to dismiss this petition.

Having regard to the submissions made and the material placed on record, including the statement recorded under Section 183 of BNSS of the victim, the petitioner's role is limited to extent of arranging a room to A.1 and victim. Considering the allegations against the petitioner, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.

The petitioner/A.2 shall surrender before the Station House Officer, Kodad Rural Police Station, Suryapet District, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty five Thousand only) with two sureties, for the like sum each.

ii.

The petitioner/A.2 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.2 shall abide by the other conditions stipulated in Section 482(2) of BSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
