THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12671 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A2 in COR/Crime No.344 of 2023 on the file of Prohibition & Excise Police Station, Dhoolpet, Hyderabad, registered for the offences under Sections 8(c), r/w.20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 8(b)(i) of the A.P.Prohibition Act, 1995.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Excise Enforcement Personnel raided the premises in Dhoolpet are and found contraband of liquor and Kgs.1.350 grams of Ganja from Accused No.1. On confession made by A1, this petitioner was arrayed as A2.

Keeping in view that the basis for implication of this petitioner is only confession by A1, the relief of regular bail can

be granted to this petitioner/A2, subject to following conditions:- i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of II Additional Metropolitan Sessions Judge, Hyderabad.

ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer on every Monday and Wednesday at 10:00 a.m. for a period of eight weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
