HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.1218 OF 2015 ORDER:

The petitioner prays for Mandamus declaring the inaction of 2nd respondent in disposing of the representation of petitioner dated 24.11.2015 filed for refund of Rs.7,06,800/-, as illegal and arbitrary. The issue arises under the Stamp Act. The petitioner filed representation dated 24.11.2014 praying for refund of Rs.7,06,800/- paid as stamp duty at the time of presentation of documents on 06.06.2013. For the reasons recorded by the Department, the subject document could not be registered. Hence, the request for refund. Heard learned counsel for the petitioner and the Government Pleader. The claim for refund relates to stamp duty paid on 06.06.2013. The timely disposal of representation is required in matters where financial implications are involved. Therefore, the 2nd respondent is directed to dispose of representation dated 24.11.2014 after giving opportunity to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
