HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3592 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.1 to 3 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.119 of 2015 of IV Town Police Station, Kurnool, Kurnool District, registered for the offences punishable under Sections 498-A and 307 IPC and Sections 3 & 4 of Dowry Prohibition Act.

2) Heard learned counsel for the petitioners/ accused Nos.1 to 3, who are no other than father-in-law, mother-in-law and sister-in-law of 2nd respondent-de facto complainant and learned public prosecutor for 1st respondent-state before admission and before ordering any notice to 2nd respondent-de facto complainant. Perused the material on record.

3) A perusal of the material on record would show that husband of 2nd respondent-de facto complainant died in the recent past by committing suicide on 20.03.2015. In fact, learned counsel for petitioners/ accused Nos.1 to 3 stated that the petitioners/ accused Nos.1 to 3 obtained anticipatory bail and availed the concession. 4) Learned Public Prosecutor submits that investigation completed and charge sheet has to be filed.

5) Having regard to the above, the application is disposed of, giving liberty to petitioners in the event of police filing final report and cognizance taken by the Magistrate to file fresh proceedings independently.
