HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30603 OF 2018 ORDER :

This petition is filed for a writ of Mandamus declaring the action of the 3rd respondent in not registering the petitioner's complaint dated 27.07.2018, as illegal and arbitrary.

Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of the petitioner the respondent police entered the same in General Diary on 29.07.2018 and conducted preliminary enquiry which revealed that there are family disputes between the petitioner and his wife; and that a case is also registered with Bheemavaram Police Station of West Godavari District, on 05.01.2018 vide Crime No.7/2018 under Section 498 A IPC and 3 and 4 of Dowry Prohibition Act against the petitioner at the instance of 4th respondent. It is also stated that after preliminary enquiry, complaint lodged by the petitioner was closed since there exists matrimonial disputes between the petitioner and his wife; and that the same was also informed to the petitioner by sending notices through registered post.

But the learned counsel for the petitioner disputes the same.

In view of the above, the writ petition is disposed of directing the respondent police to inform the petitioner regarding action taken on his complaint and it is also open for the petitioner to avail alternate remedy as may be available to him under law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 06.09.2018 t k.
