Heard learned counsel for the parties.

The petitioner states that he gave a complaint on 27.9.2014 to third respondent who registered it as a case in Cr.No. 488 of 2014 under Sections 420, 468 and 471 IPC on 27.9.2014, but he is not investigating the case. Hence the present writ petition.

Learned Government Pleader for Home, on

instructions from third respondent, submits that after registration of the crime, the third respondent examined five witnesses including the petitioner and recorded their statements and also obtained certified copies of the documents in question from the District Registrar and sought for attendance extract copy of the petitioner from Air India Limited and further investigation is proposed to be made by examining some more witnesses and getting the original gift deed dated 13.9.2011. The investigating Officer also states that there was some delay, but that was on account of the time taken for collecting the material evidence, however he assures the Court that appropriate expeditious steps will be taken for completing the investigation.

In view of the averments and assurance of the investigating officer, it would be just and proper to dispose of this writ petition by directing the third respondent to complete the investigation expeditiously and file appropriate final report before the jurisdictional court. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
