THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.8452 of 2016

ORDER

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in S.C.No.244 of 2015 on the file of the Assistant Sessions Judge, Proddutoor, YSR Kadapa District. Heard the learned counsel appearing for the petitioners/A.2 to A.7 and the learned Additional Public Prosecutor representing the State.

A perusal of the complaint, discloses that there is material which is sufficient to proceed with the investigation and prima-facie, it cannot be said that it is a fit case that the proceedings are liable to be quashed.

In that view of the matter, the Criminal Petition is disposed of directing the learned Assistant Sessions Judge to proceed with the trial in S.C.No.244 of 2015 and without further insisting for the presence of the petitioners/A.2 to A.7 on each and every adjournment, unless it feels that their presence is necessary for any specific purpose.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
