THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.20893 OF 2008 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ of Mandamus or any other appropriate writ or writs order or Direction declaring the Memo dt.20-8-2008 in Rc No.1851/2008/TRI/VC-2 on the file of the third respondent herein, as illegal, and arbitrary by consequently directing the Respondents to forthwith admit the petitioner into B.Tech Court in Computer Science discipline in 6th Respondent College and permit him to attend the Classes and write the examinations by declaring results; Award costs, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. Heard Sri N.Sridhar Reddy, learned counsel, appearing for the petitioner, learned Government Pleaders for Social Welfare and Revenue and Sri C.Sudesh Anand, Standing Counsel for APSCHE appearing for the respondents.

3. This Court while ordering Rule Nisi on 24.09.2008, granted interim suspension of the impugned Memo bearing Rc.No.1851/2008/TRI/VC-2, dated 20.08.2008, issued by the Director, Tribal Welfare Department, in W.P.M.P.No.27306 of 2008.

4. Today when the matter is called, it is reported by the learned counsel for the petitioner that, in terms of the interim order, petitioner had already completed the course. On the contrary, it is requested by the learned Government Pleader to keep it open for the authorities to enquire into with regard to the social status of the petitioner herein. This Court considers the said request as reasonable.

5. In view of the above and having regard to the nature of controversy, writ petition is disposed of, keeping it open for the respondent authorities to enquire into the social status of the petitioner herein.

6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall
