THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN TRANSFER CRIMINAL PETITION No.299 OF 2014 ORDER:
No representation for the petitioners. Pleadings perused.
2. There is no interlocutory order granted in favour of the petitioners. The petitioners are accused persons in a matter alleging offences punishable under Sections 420, 423, 499 and 506 I.P.C. The plea is that the first accused is a Police Constable in the A.P. Service and there is also a case against him in the Cyberabad Court under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. It appears, the 2nd respondent also filed two cases against the 3rd petitioner, which are stated to be pending before the Court of the Senior Civil Judge, Gudur. The plea is that the petitioners find it difficult to shuttle between different places to have the cases conducted.
3. Having regard to the different ingredients, which would constitute different offences for which the petitioners were put to trial are not those which can be ordered to be tried, as sought for by the petitioners, this application cannot be considered.
4. Under such circumstances, the Transfer Criminal Petition fails and is, accordingly, dismissed.
5. Miscellaneous applications, if any, pending, shall also stand closed.
