This Writ Petition is filed for a Mandamus to declare the action of the respondents, in treating the petitioner's lands admeasuring Ac.0-82 cents, Ac.0-76 cents, Ac.0-42 cents and Ac.2-04 cents in Survey Nos.357/1, 363/2, 359 and 354/2 respectively of Anantapuram Revenue Village, T.P.Gudur Mandal, SPSR Nellore District, as endowment lands and seeking to evict the petitioner therefrom without following the due process of law, as illegal and arbitrary. The petitioner sought for a consequential direction to the respondents not to interfere with his possession and enjoyment of the aforesaid lands.
Mr.P.Ganga Rami Reddy, learned Counsel for the petitioner, has addressed letter, dated 13-11-2015, to the Registrar (Judicial) wherein it is stated that the proper and necessary parties are not impleaded and the relevant survey numbers are also not included in the Writ Petition and that therefore, the petitioner seeks to withdraw the Writ Petition with liberty to file a fresh Writ Petition.
At the hearing, the learned Counsel for the petitioner has reiterated the contents of the said letter and made a request for withdrawal of the Writ Petition.
The request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as
withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, WPMP.No.41804 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous.
