THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CRIMINAL PETITION No.653 of 2013 ORDER:

The petitioner herein sought for quashing C.C.No.1132 of 2012 on the file of the Additional Judicial First Class Magistrate, Anantapur.

The defacto complainant, who is a contractor, has reported that the petitioner herein has called him up on 26.01.2011 at 04.30 p.m. and threatened him to write his name on the fly-over bridge and also demanded him to pay cash of Rs.20,00,000/- as goodwill as the construction of the fly-over itself was the result of the pursuits made by the petitioner herein. Sri T.Pradyumna Kumar Reddy, learned counsel for the petitioner, would submit that the complaint itself is based upon imaginary grounds. In fact, the State Government has been recognizing the efforts put in by the petitioner as a Member of Parliament for securing the sanction of construction of fly-over and then getting it executed.

As it turned out now the State Government has officially recognized the services of the petitioner to the society at large and in particular recognized the efforts put in by him for construction of the fly-over bridge and the State Government issued orders through their G.O.Rt.No.1062 Municipal Administration dated 12.09.2002 naming the fly-over bridge as Saifulla bridge, the name of the petitioner herein.

In fact, invitations which were extended by the Superintending Engineer, Public Health department, clearly shows that the bridge was named as K.M.Saifulla fly-over bridge. Hence,

the question of the petitioner insisting upon the contractor to write his name on the bridge as he is the principal person involved in securing the sanction of the bridge itself would not arise. In that view of the matter, this petition is allowed as the contents of the complaint are more imaginary than being real. The C.C.No.1132 of 2012 on the file of the Additional Judicial First Class Magistrate, Anantapur in so far as the petitioner is concerned, is quashed. No costs.

The miscellaneous applications, if any shall also stand dismissed.
