HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26538 OF 2009 O R D E R :

The case of the petitioner is that it is a society consisting of about 15 women as its members, who are all the poor people belonging to socially and economically backward class. Initially, the petitioner's society was entrusted with cooking of midday meals in the primary school consisting the strength of 50 to 60 children. As the performance of the petitioner's society was found to be satisfactory, it was entrusted with cooking of mid day meals to Zilla Parishad Secondary School, Palakurthi consisting the strength of 450 students. Appreciating the performance of the petitioner's society, the Head Master, Zilla Praja Parishad Secondary School, Palakurthi, issued a certificate dated 23.04.2009. The Collector of Warangal also issued a certificate dated 10.06.2002 appreciating the petitioner in participating in 17th Janmabhoomi programme.

While so, the 1st respondent vide impugned proceedings dated 20.11.2009, appointed the 5th respondent as a cooking agency of Zilla Parishad Primary School by removing the petitioner, without any prior notice. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that though petitioner's performance was appreciated as a cooking agency, the 1st respondent appointed 5th respondent in place of the petitioner without assigning any reasons.

On the other hand, learned Standing counsel Sri G.Narender Reddy, appearing for respondents 2 and 3 submits that now the mid day meal scheme has been changed and all together there are about

150 societies in the Mandal and on rotation basis, cooking agencies are appointed.

It is to be seen that petitioner has not shown any legally enforceable right for continuing the petitioner as cooking agency for both the schools and there is no allegation against the petitioner's society. In order to give an opportunity to a new agency, the respondents have entrusted the cooking agency to the 5th respondent. It is not known why petitioner alone should be granted cooking agency to both the schools. Moreso, according to the changed scenario, the cooking agencies are appointed on rotation basis.

In view of the above facts and circumstances, I do not see any merit in the writ petition. Accordingly, the writ petition is dismissed. No costs.

As a sequel, miscellaneous petitions, pending, if any shall stand closed.
