THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1690 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following Order is passed:

Having regard to the fact that Charge sheet has been filed against the accused for the offence under Sections 323 and 506 IPC and under Section 3 (i) (x) of SCs and STs ( POA) Act, 1989 and the Charge sheet has been accepted and the case is registered as S.C.No.99 of 2013, it is not apt to quash the proceedings. If the petitioner/accused is so advised, he can file discharge application putting forth all his defences stating that no case is made out against him from the Charge sheet and other material and in which case, the trial Court shall dispose of the said discharge application on merits at the earliest.

With the above observation, the Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed. ______________________ U.DURGA PRASAD RAO,J 17-03-2015 eha.
