HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30482 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the fourth respondent in not receiving and registering the sale document pertaining to the land admeasuring Ac.0.4 1⁄2 cents out of ac.0.29 1⁄2 cents in Sy.No.314-1 situated at Gorantla Village and Mandal, Anantapur District and insisting upon no objection certificate from the respondents 2 and 3, as illegal and arbitrary.
2) When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the lis in the Writ Petition is squarely covered by the order 24.07.2012 in W.P.No.22485 of 2012 passed by this Court and the same is not disputed by the learned Assistant Government Pleader for Revenue.
3) For the reasons alike, the Writ Petition is disposed of directing the fourth respondent to receive and process the document presented by the petitioner for registration without insisting for submission of " No Objection Certificate" from the revenue authorities and if the same are not included in the list of prohibited properties under Section 22-A of the
Registration Act, 1908 or no injunction order prohibiting registration of subject lands is in operation and the same is in order as per provisions of Indian Stamp Act, 1899, the Registration Act and the Rules made thereunder. Otherwise, he shall record the reasons for refusal of the registration and communicate the same to the parties.
4) There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
