HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11174 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Telangana.

2. This writ petition is filed seeking writ of Mandamus declaring the action of respondents 2 to 4 in not permitting the petitioner to run her fair price shop No.2 at D.No.2-90, Pasumamula Village,Hayathnagar Mandal, Ranga Reddy District, though her authorisation is valid up to 31.03.2016, as illegal and arbitrary.

3. The Fair Price shop of the petitioner was inspected by the authorities on 13.04.2015 and certain variations have been noticed in the stock, apart from some other irregularities. The variations in respect of certain commodities are not within permissible limits. Since the fair price shop of the petitioner was seized and a case under Section 6-A of the Essential Commodities Act, 1955, was registered against the petitioner, this Court is of the view that a detailed enquiry has to be conducted on the allegations levelled against the petitioner. Hence, the 3rd respondent-Revenue Divisional Officer, Saroornagar Division, Ranga Reddy District is directed to conduct enquiry against the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.
