THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY TRANSFER CRIMINAL PETITION Nos. 188 AND 189 OF 2018 COMMON ORDER:

Transfer Criminal Petition Nos. 188 and 189 of 2018 are filed under Section 407 of Cr.P.C. to withdraw D.V.C.No. 13 of 2018 and M.C.No. 112 of 2017 respectively from the file of the Court of II Additional Judicial I Class Magistrate, Bhimavaram, West Godavari District (for short, 'the Court below'), and transfer the same to the file of Family Court, Jaggaiahpet, Krishna District. 2.

Heard learned counsel for the petitioner.

The reason assigned by learned counsel for the petitioner for transfer of both the cases is that there is life threat to the petitioner in case he attends the Court below from the persons of respondent No. 1 and that therefore it is difficult for him to attend the Court below on the dates of adjournment to face trial. 4.

Having regard to the above, if sufficient police protection is provided to the petitioner through the Court below, he can appear before it without any fear in his mind. Therefore, the Court below is directed to provide necessary police protection to the petitioner whenever he appears before it in connection with the above cases on his application subject to bearing expenses. 5.

With the above direction, both the transfer criminal petitions are disposed of. Pending miscellaneous petitions, if any, shall stand closed in consequence. _____________________________ Date: 28-08-2018.
