HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17445 of 2015 ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner is appointed as a Fair Price Shop Dealer of shop No. 42 of Pathapadu village, Kanigiri Mandal, Prakasam District. On 26.12.2014 the Enforcement Deputy Tahsildar, Kanigiri inspected the shop of the petitioner and noticed some variation in stocks. The third respondent issued a show cause notice on 17.03.2015 based on the report of the Enforcement Deputy Tahsildar dated 27.12.2014. The petitioner was asked to submit his explanation within seven days. But the petitioner did not submit his explanation within the said period. Thereafter the third respondent passed impugned order dated 6.4.2015 suspending the authorization of the petitioner pending further enquiry. Challenging the said order, the present Writ Petition is filed.
Along with the Writ Petition, the petitioner filed a copy of the explanation submitted to the third respondent on 13.4.2015. It appears that the petitioner also preferred an appeal against the impugned order before the second respondent. However, since the petitioner has already submitted his explanation, the third respondent is directed to complete the enquiry by duly observing the principles of natural justice and pass final order within a period of 30 days from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
