HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21516 OF 2011 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to declare the action of the first respondent in not considering the case of the petitioner and not passing final orders on the enquiry conducted under B.S.O.
(18), pursuant to the notice in Roc.No.E4/2020/2010, dated 11.06.2010 as illegal and incorrect and consequently direct the first respondent to consider the case of the petitioner and pass orders at the earliest.
The averments in the affidavit filed in support of the Writ Petition would show that the first respondent vide proceedings No.E4/2020/2010, dated 11.06.2010, issued a notice to the petitioner directing him to appear before him for hearing on 19.06.2010 at Collector's Office, Chittoor.
Pursuant to which, the petitioner appeared and submitted his written explanation stating all the facts and requested first respondent to withdraw the said proceedings by issuing No Objection Certificate permitting the petitioner to sell away the said lands. After hearing the petitioner, the first respondent informed that he would pass orders. It is stated that till date no orders are passed in the said proceedings. Aggrieved by the same, the present Writ Petition came to be filed.
Learned Government Pleader for Revenue (Andhra Pradesh),
on instructions, submits that the said proceedings are still pending and no orders are passed till date.
Without going into the merits of the case and having regard to the grievance of the petitioner, the Writ Petition is disposed of directing the first respondent to pass orders in proceedings E4/2020/2010, dated 11.06.2010, within a period of six (06) weeks from the date of receipt of a copy of this order. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
