THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13820 of 2025 This Criminal Petition is filed seeking the Court to relax the conditions imposed by the learned VIII Additional District and Sessions Judge, Ranga Reddy at L.B. Nagar FAC. Special Sessions Judge for Trial and Disposal of cases under POCSO Act, Ranga Reddy District, at L.B. Nagar in Crl.M.P.No.844 of 2025 in Crime No.661 of 2025 of Chaitanyapuri Police Station vide order dated 08.10.2025 to the extent of the petitioner appearing before the SHO, Chaintanyapuri Police Station on every Monday and Saturday between 10.00 am and 2.00 pm and to cooperate with, if any, medical examinations.

Heard Sri T. Rahul, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent No.1-State.

Learned counsel for petitioner submitted that, as the petitioner herein is the accused in the present case, he has already undergone potency test during the remand period itself and the petition filed by the Investigating Authority is allowed by the trial Court and he underwent potency test for three times during the remand period and there is no necessity for taking the petitioner for medical examinations. It is further submitted that, after releasing on bail, the petitioner has complied with all the conditions of bail imposed by the trial Court. As such, prayed the Court to relax the conditions imposed by the trial Court including the condition imposed by the trial to appear before the SHO, Chaintanyapuri Police Station on every Monday and Saturday between 10.00 am and 2.00 pm till filing of charge sheet.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the bail was granted to the petitioner on 08.10.2025 and he has to appear for the investigation till the investigation is under

progress and the presence of the petitioner is necessary for concluding the investigation.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, this Criminal Petition is partly allowed relaxing the condition that the petitioner has to cooperate with the investigating Officer and if any, medical examinations and he shall not threatened the victim to the extent of medical examinations and if any further medical examinations, the prosecution has to file an application before the Court and therefore, the said condition is partly allowed dismissing the petition for relaxation of other conditions.

Miscellaneous applications, if any pending, shall also stand closed.
