HONOURABLE SRI JUSTICE S.RAVI KUMAR Tr.CMP.No.13 of 2014 O R D E R:

This petition is filed to withdraw O.P.No.65 of 2013 from the file of Senior Civil Judge, Nizamabad District and transfer the same to Family Court, Mahabubnagar. Advocate for petitioner submitted that though it is mentioned as Senior Civil Judge, Nizamabad, the O.P. is now pending before Additional Senior Civil Judge, Armoor, Nizamabad District. Wife filed this application seeking transfer on the ground of convenience. She filed O.P.No.23 of before the Family Court, Mahabubnagar for restitution of conjugal rights and that was dismissed as not pressed due to compromise. In her affidavit, it is stated that her father is a retired teacher and she is not in a position to travel from Nizamabad District to Mahabubnagar District, which is around 270 kms for defending this case and therefore she sought transfer of the O.P.

Respondent inspite of service of notice neither appeared in person nor through any advocate.

Heard arguments.

Considering the reasons stated in the affidavit and also considering the convenience of the wife O.P.No.65 of

2013 is withdrawn from Additional Senior Civil Judge, Armoor, Nizamabad District and transferred to Family Court, Mahabubnagar for disposal in accordance with law. Transfer Petition is ordered accordingly.

Miscellaneous petitions, if any, pending in this petition, shall stand closed.
