HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.21591 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and Sri N. Vasudeva Reddy, learned standing counsel for the respondents.
2. It is the case of the petitioners that, one B.S.Raju, husband of 1st petitioner and father of the 2nd respondent, while working as Electrician in the 3rd respondent-Depot, died on 16.04.2010 in the road accident, leaving the petitioners as his legal heirs. Thereafter, the 1st petitioner filed a representation before the respondents on 22.04.2010 seeking compassionate appointment to the 2nd petitioner, but so far no action has been taken. According to the petitioners, the 1st respondent issued notification dated 10.02.2015 for restoration of the bread winner scheme and to invite the applications from the dependents of the deceased employees afresh, who died in service during the ban period from 01.01.1982 to 04.01.2013. Though the petitioners submitted fresh application on 19.02.2015, there was no response from the respondents and hence, they filed the present writ petition seeking direction to the respondents to consider the case of the 2nd petitioner for compassionate appointment as per the Notification dated 10.02.2015.
3. In the circumstances, the petitioners are directed to submit fresh representation to the respondents seeking compassionate appointment within a period of two weeks from the date of receipt of a copy of this order and the respondents are directed to consider the case of the 2nd petitioner, subject to his eligibility, for appointment on compassionate grounds under 'Bread Winner Scheme' of the respondents, within a period of eight (8) weeks, thereafter and pass appropriate orders thereon.
4. The writ petition is accordingly disposed of. Miscellaneous applications, if any, in this writ petition, shall stand closed. No order as to costs.
