ORDER
This petition is filed under Section 482 Cr.P.C., by the petitioner questioning the inaction of the XXI Metropolitan Magistrate, Medhcal, Rachakonda not disposing Crl.M.P.No.1763 of 2017 in C.C.No.1029 of 2017 filed under Sections 451 and 457 Crl.P.C. for interim custody of Ashok Lay Land Lorry bearing Chasis No.MB1KCFD5HPGW7971, Engine No.GHPZ147625 and TR No. TS 10 VTR 6913.
Learned counsel for the petitioner submitted that the said petition is filed in the month of August, 2017 and it is not yet disposed of. As per the judgment of the Apex Court in Sunderbhai Ambalal Desai v State of Gujarat1, the Court has to dispose of the property within one month from the date of seizure in a petition filed under Sections 451 and 457 Cr.P.C. Therefore, in view of the submissions of counsel for the petitioner and in view of the principles laid down in the judgment of the Apex Court in Sunderbhai Ambalal Desai's case referred supra, XXI Metropolitan Magistrate, Medchal is directed to dispose of Crl.M.P.No.1763 of 2017 in C.C.No.1029 of 2017 within a week from the date of receipt of a copy of this order.
With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand dismissed.
