HONOURABLE SRI JUSTICE S.RAVI KUMAR TR.C.M.P.No.241 OF 2016 ORDER:

This application is filed to withdraw H.M.O.P.No.721 of 2014 from Family Court, Vijayawada and transfer the same to Chittoor.

Wife filed this application. According to her affidavit, her marriage was performed on 31-5-2013 at Venkusa Kalyana Mandapam, Kttamanchi, Chittoor District as per Hindu Rites and Caste custom and after marriage, , she led marital life for one year and they are blessed with baby on 21-11-2014 and thereafter, respondent and his family members started harassing her both mentally and physically and panchayat conducted by elders has not yielded any result and having no other option, she went to her parents house and she filed a private complaint before IV Additional Judicial Magistrate of First Class Chittoor, and respondent herein filed H.M.O.P.No.712 of 2014 before Family Court, Vijayawada seeking transfer. She stated that she appeared before Family Court, Vijayawada and filed counter.

She stated that she is suffering from severe ailment and it is difficult for her to attend Family Court, Vijayawada from Chittoor and her parents are aged parents and not in a position to accompany her to Vijayawada.

This court permitted petitioner's advocate to take personal notice to respondent by registered post with acknowledgement due and in compliance of the said order, advocate for petitioner filed memo dated 7-6-2016 stating that notice sent to the respondent returned with endorsement unclaimed, and returned cover is filed along with memo.

Heard arguments.

Considering the reasons stated in the affidavit, which remained unrebutted, request of wife for transfer of O.P. from Vijayawada to Chittoor, is considered.

Therefore, O.P.721 of 2014 is withdrawn from Family Court, Vijayawada and transferred to Family Court, Tirupathi for disposal in accordance with law.

Petition is ordered accordingly. No costs.

As a sequel to the disposal of this petition, Miscellaneous Petitions, if any, pending, shall stand dismissed.
