THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.2175 of 2015 ORDER:

This Contempt Case is filed alleging non-implementation of the order in W.P.M.P. No.45324/2015 in W.P. No.35277/2015 dated 29.10.2015, which reads as follows:

"Heard.

Pursuant to the application of the petitioner, an order was passed on 2-52015 according permission for shifting his AP Online Mee Seva Center from Kothapalli Village to H.No.9-25-60, Janatapeta Road, Kavali, on the ground that broad band connectivity for the Kothapalli village was not sufficient. Now the impugned order dated 9-10-2015 was passed canceling the earlier orders dated 2-5-2015 permitting the petitioner to shift his AP Online Mee Seva Center from Kothapalli village to Kavali, which virtually closes the services run by the petitioner.

In the circumstances, this Court is prima facie satisfied about the untenability of the impugned order dated 9-10-2015 and accordingly, there shall be interim suspension as prayed for."

Counter affidavit is filed by the respondent stating that the respondent could not implement the orders only due to the legal opinion of Government Pleader, Nellore, however, implemented at a later stage after obtaining 2nd opinion of Government Pleader for Revenue, as such there is no intentional violation by showing deliberate disobedience to this Court and hence, the Contempt Case may be closed.

Recording the said submission, this Contempt Case is dismissed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Contempt Case shall stand closed.
