Heard.

Alleging inaction on the part of respondents 3 and 4 in completing investigation and filing charge-sheet in Cr.No.86 of 2013, in spite of lapse of almost two years, the present writ petition is filed. Learned Government Pleader has received instructions, which state that after recording the evidence of LWs.1 and 2 sent requisitions to the websites to block/delete the content and to collect details of uploader. It is also stated that during investigation, Cyber Crimes Police Station staff apprehended the accused on 30-082013 and his statement was recorded in the presence of mediators. It is stated that he has confessed about uploading of offensive photos.

The police also state that they have visited the house of the 5th respondent and recovered laptop and the same was sent to the Central Forensic Laboratory, Ramanthapur, for analysis and report. The CFSL authorities opined that the 5th respondent has used his laptop to commit the offence. After arrest, the accused is said to have been produced before the jurisdictional court and that investigation is completed and draft charge-sheet is also prepared and is awaiting for approval of superior officers and as soon as the approval is received, final charge-sheet will be filed before the jurisdictional court.

Since the entire investigation is completed and charge-sheet is likely to be filed shortly, it is not necessary to retain the writ petition any further and the same is therefore, disposed of directing respondents 3 and 4 to ensure that appropriate charge-sheet is filed in Cr.No.86 of 2013 at the earliest and take all further necessary actions to see that the trial, in pursuance of the charge-sheet is completed expeditiously. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________
