THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.25842 of 2015 O R D E R:

This writ petition is filed under Article 226 of the Constitution of India for the following relief - " For the reasons stated in the accompanying affidavit the petitioners herein pray the Hon'ble Court may be pleased to issue writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the 3rd and 4th respondents herein calling the petitioners to the police station without their being any complaint or case registered against them and thereby interfering with their personal life and liberty as being illegal, arbitrary and violates the fundamental right of the petitioners guaranteed under Article 21 of the Constitution of India and further direct the respondents to pay compensation to the petitioners 2 and 3 since they are senior citizens and being harassed by the police and pass such other order or orders as the Hon'ble Court may deem fit and proper in the interest of justice and circumstances of the case."

When the matter is taken up for consideration, written instructions dated 21.8.

" It is respectfully submitted that one Mr.Srinivas Rao s/o Rajeswara Rao, R/o Veeraiahpalli, H/o. Chelpur, Ghanpur (Mulug) Mandal has came to the police station and preferred a complaint on 10.7.2015 stating that his wife by nam Smt. Nagamani, aged about 25 years is missing since 7.7.2015 and the same has been registered as "Woman missing" in Cr.No.112/2015 and investigation is being taken up. The investigation is pending till today. In the meanwhile this respondent received a phone call from I Town PS, Godavari Khani and they informed that Smt. Nagamani made a complaint against her husband and her in-laws under Sec.498-A, 506 r/w 3 and 4 of Dowry Prohibition Act and the same was registered as Cr.No.308/2015 in I Town PS, Godavari Khani.

It is submitted that the petitioners herein were never called to the PS in connection with this case or any other case. The allegation of the petitioners that they are being harassed by the police is not at all true. On the apprehension that they would be called for by the police, they are making false and frivolous allegations."

Noticing the said instructions, learned counsel for the petitioners requests to dispose of the writ petition by recording the above written instructions dated 21.8.2015. In view of the above, the writ petition stands disposed of by recording the above written instructions dated 21.8.2015 furnished by the Sub Inspector of Police, Ghanpur (Mulug) Police Station, Warangal District. Miscellaneous applications, if any pending in the writ petition, shall stand closed. No costs.
