Mohd. Khaleemuddin v. The District Collector

HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE S.V.BHATT WRIT APPEAL No.1174 OF 2018 JUDGMENT: (Per the Hon'ble Sri Justice S.V.Bhatt) Heard Md.Afzal for appellants and the learned Government Pleader (Revenue) for respondents.

The writ petitioners are the appellants. The appellants challenge Proceedings No.D/7858/98 dated 04.11.2001 and consequent endorsement No.D1/78/2004 dated 09.12.2004 as illegal and arbitrary.

The appellants applied for mutation of their names in revenue records for the agricultural lands measuring Acs.3-02 Gts in Sy.No.299; Acs.13-19 Gts in Sy.No.282; Ac.0-15 Gts in Sy.No.283; Ac.0-30 Gts & Acs.13-19 Gts in Sy.No.270; Acs.1-30 Gts in Sy.No.280; Acs.15-23 Gts in Sy.No.220 and Acs.11-36 Gts in Sy.No.232 of Kothur Village, Mahabubnagar District. The appellants raised their claim for incorporation in revenue record on proceedings dated 06.09.1959.

The learned Single Judge found that in effect seeks implementation of proceeding dated 06.09.1959 and the Joint Collector/2nd respondent rightly rejected the request of appellants by referring to alienation of land in favour of 3rd parties and incorporation

of predecessors/possessors in revenue records. The nutshell of the case is briefly stated above.

We have perused the record and are satisfied that the writ appeal is without merit and fails.

The writ appeal is, accordingly, dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, stand closed.
