Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner states that she is a resident of Idupulapadu Village of Inkollu Mandal, Prakasam District and she is having an extent of Ac.2.00 wet land in Survey No.84/8. One of her sons is the Fair Price Shop Dealer of Shop No.38 in the said village. After harvest of the crop, she kept 22 plastic bags of 50 kg each in a separate row by the side of the PDS rice bags. While so, on 16.12.2014, the Vigilance and Enforcement Officials headed by the Enforcement Deputy Tahsildar, Yerragondapalem and his staff inspected the Fair Price Shop of her son and seized the rice meant for distribution as well as the rice belonging to her. The officials seized stocks, and as per her claim it is not meant for public distribution. The proceedings against the son of the petitioner are pending.
The petitioner submitted a representation for release of the stock on 18.12.2014 to the 1st respondent. When the 1st respondent has not passed any order on the said representation, the present writ petition is filed. In view of the averments made by the petitioner in her affidavit, this writ petition cannot be kept pending and can be disposed of at the admission stage by directing the 1st respondent to consider the representation dated 18.12.2014 filed by the petitioner and dispose of the same after hearing her in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Pending miscellaneous petitions in this Writ Petition, if any, shall stand closed in consequence.
