HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.8026 of 2011 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the action of the respondent in not paying compensation for acquisition of the land of the petitioner admeasuring 647.77 square yards along with old structures, situated at Somajiguda, Hyderabad, as illegal and arbitrary, and consequently, direct the respondent to pay compensation for the acquired land to the petitioner under the Land Acquisition Act.
Heard and perused the material available on record. The case of the petitioner is that the respondent acquired the land of the petitioner admeasuring 647.77 square yards, out of a total extent of 17,700 square yards, for the purpose of widening of the road, and that the possession of the property was also handed over to the respondent. But, the respondent has not paid the compensation to the petitioner. The grievance of the petitioner is that though the petitioner made number of representations, the respondent has not paid the compensation so far.
Considering the facts and circumstances of the case and also the grievance of the petitioner, this Court is of the view that the writ petition can be disposed of with the following directions: The petitioner is directed to file a fresh representation incorporating the contentions raised in this writ petition on or before 30.03.2017 to the authorities concerned along with a copy of this order. On such representation being filed, the concerned authority of the respondent Corporation is directed to pass appropriate orders as
expeditiously as possible, more particularly within a period of three (3) months.
Accordingly, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J February 28, 2017.
