No. 122 of 2022 on the File of Keshavapatnam Police Station, Keshavapatnam, for the offences under Sec.302 rlw.34 and 109 IPC against the petitioner herein and pleased to pass such other order or orders as may deem fit and proper in the circumstances of the case l.A. The present application is filed under Section 482 of Cr.P.C t tr It praying this Court to quash the proceedings against the petitioner/accused No.3 in Crime No.i22 of 2022 on the file of Keshavapatnam Police Station, Keshavapatnam. The offences registered against the petitioner are under Section 302 read with 34, 109 of IPC.

2. A complaint was filed on 0L.07.2022 by the defacto complainant/respondent No.2 stating that his brother was killed by accused No.l & 2 by hitting him on his head with a boulder. In the said complaint he expressed suspicion that this petitioner may be indirectly involved. In the remand report of accused Nos.I & 2 on 15.07.2022, it is mentioned that offence is yet to be established against this petitioner.

In the said circumstances, even according to the remand case diary, the evidence was not established against the petitioner and as on date, no efforts were taken by the police to apprehend this petitioner. This court deems it appropriate to direct the police to

conclude the investigation without arresting the petitioher. The petitioner shall cooperate with the police in concluding investigation. 4.

Accordingly, this petition is disposed off.
