Mohammed Sajid, v. The State Of Telangana
THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.2070 of 2015
ORDER
Heard learned counsel for the petitioners and learned Government Pleader for Home.
2. The petitioners herein claim to be the absolute owners and possessors of Acs.12.27 gts in Sy.No.691 of Korutla Village and Mandal, Karimnagar District. Petitioners also state that with regard to their civil dispute, they have approached this Court in W.P.No.22129 of 2014, and this Court, by order in W.P.M.P.No.27749 of 2014 dated 05.08.2014, directed that status quo obtaining as on that date to be maintained by all the parties. Petitioners state that while the said order is in force, respondents 3 and 4, at the instance of the third parties, are objecting the petitioners not to enter into the said agricultural lands and not to conduct agricultural operations. Hence, the said action of respondents 3 and 4 is questioned on the ground that it amounts to interfering with the civil dispute relating to the land between the petitioners and third parties.
3. Instructions received by the learned Government Pleader for Home, however, show that the petitioners had approached the 4th respondent on 27.01.2015 by making a complaint that while they are in possession of the aforesaid land, one Md. Amer has been interfering with the same and therefore, requested the police to take action against him. Based on the said complaint, the 4th respondent made GD entry No.567 dated 27.01.2015 and the petitioners were requested to produce necessary documents for verification and after examining the same, further action would be
taken. It is also mentioned that Cr.No.33 of 2015 was registered on the file of 4th respondent on 29.01.2015 on the basis of the compliant of one M.A.Amer, S/o.Azizoddin Hussain against one Molla Masood, Md. Afroz and Md. Rafioddoin also alleging criminal trespass into the land in Sy.No.657. While the investigation of the said case is stated to be pending, it is categorically stated that the petitioners herein are not the accused arrayed in the said crime. So far as the petitioners' allegation of interfering with the civil dispute is concerned, respondents 3 and 4 state that they have nothing to do with the said civil dispute and they never interfered with the same at any point of time and that the 4th respondent has never interfered with the agricultural operations of the petitioners as alleged.
4. In view of the said categorical statements, the respondent No.4 shall confine to investigation of Cr.No.33 of 2015 in accordance with law and that they are not interfering with the civil dispute and the agricultural operations of the petitioners, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
