THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12703 of 2023 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/accused No.1 seeking anticipatory bail in the event of his arrest in connection with F.I.R No.217 of 2023 dated 03.09.2023 on the file of the Ellanthakunta Police Station, Rajanna Sircilla District, registered for the offences punishable under Sections 290, 324 and 506 r/w 34 of the Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the respondent-State and perused the record.

The mother of the petitioner filed a complaint alleging that her sons who are petitioner and another have attacked her husband in the dispute regarding property. The said assault was caused with a stick resulting in grievous injury to the father. 3.
Learned counsel for the petitioner would submit that initially, the crime was registered under Section 324 of IPC, however, altered the Section of law to 326 of IPC without any basis.

Keeping in view that there are family disputes regarding the property, this Court deems it appropriate to grant relief of
anticipatory bail to the petitioner, subject to the following conditions:
1) The petitioner/accused No.1 is directed to surrender before the Station House Officer, PS, Ellanthakunta, on or before 03.01.2024. Upon such surrender, the said Station House Officer shall release the petitioner/accused No.1 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioner/accused No.1 shall appear before the concerned police on every Monday, Wednesday and Saturday between 10am to 12pm for a period of four (04) weeks and thereafter, as and when required for the purpose of investigation and he shall stay from the parents until further orders.
3) The petitioner/accused No.1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
