HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30640 of 2018 ORDER:

The present writ petition came to be filed seeking to issue a writ of mandamus to declare the action of the respondents 2 to 4 in not responding to the representations dated 28.03.2018 and 14.08.2018, seeking issue of No Objection Certificate for getting the document relating to a house plot, admeasuring 286.11 sq.yds., in Plot No.32 in Survey No. 149 of Gayatrinagar of Gambheeram Village and Panchayat, Anandapuram Mandal, Visakhapatnam District registered, as illegal, arbitrary and consequently direct the respondents to issue No Objection Certificate to get the said land registered.

At the time when the matter is taken up, Sri T.V.S.Prabhakar, the learned counsel for the petitioner submits that since the land is included in the prohibited list, an application came to be filed by the petitioner before the District Collector, for deletion of the same, which is not considered till today. He submits that issuance of No Objection Certificate may arise at a subsequent date. 3.

The learned Government Pleader would submit that if the application made by the petitioner is in accordance with

the provisions of law, the same will be dealt with by the authorities, within ten to twelve weeks.

Having regard to the facts and circumstances of the case, the present writ petition is disposed of at the admission stage, directing the concerned, that if the application made by the petitioner is in consonance with the provisions of law, and if the said application is enclosed with all the necessary documents, the authorities shall deal with the same in accordance with law, as early as possible, preferably, within a period of ten to twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs. 5.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
