HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.7589 OF 2016 ORDER:

Sri M.A.Basith, learned counsel for the petitioner, though, represents that the present petition is filed requesting to quash the proceedings in the Calender Case, in fact, the Calender Case number is no where mentioned in the petition and the prayer in the petition reads thus:

"FOR THE REASONS MENTIONED above, it is prayed that the Hon'ble Court may be pleased to call for the records relating to and connected with FIR No.146/2014 dated 14.07.2014 on the file of XVI M.M Court, Cyberabad at Kukatpally, Hyderabad, Telangana State and quash the same against the petitioner and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

On the other hand, learned Additional Public Prosecutor for the State of Telangana on behalf of respondent No.1 would represent that on filing the charge sheet, cognizance was taken in C.C.No.24 of 2015 on the file of XVI Metropolitan Magistrate, Miyapur, Cyberabad and, therefore, the present petition becomes infructuous. In view of the aforesaid submission of learned Additional Public Prosecutor, the Criminal Petition is dismissed as infructuous at the stage of admission itself.

Miscellaneous applications, if any pending in this criminal petition, stand closed.
