THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12702 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/accused Nos.3 and 4 seeking anticipatory bail in the event of their arrest in connection with F.I.R No.416 of 2023 dated 26.11.2023 on the file of the Kazipet Police Station, Warangal District, registered for the offences punishable under Sections 498-A, 306 r/w 34 of the Indian Penal Code (for short 'IPC') and Sections 3 and 4 of Dowry Prohibition Act. 2.

Heard learned counsel for the petitioners, learned Additional Public Prosecutor for the respondent-State and perused the record.

The allegation against the petitioners are that they are parents of accused No.1. Accused No.1 was married to the deceased 17 years prior to her death which occurred on 25.11.2023 for the reason of consuming Harpic Toilet cleaner. In the complaint filed by the brother of the deceased, it is mentioned that there was a demand for additional dowry of Rs.10.00Lakhs. Apart from the said omnibus allegation made against accused Nos.1 to 5, nothing specific is attributed to these petitioners. Moreover, the petitioners are aged 74 years and 78 years.

Keeping in view that general allegation is made regarding the harassment and the age of the petitioners, this Court deems it appropriate to grant relief of anticipatory bail to the petitioners, subject to the following conditions:

1) The petitioners/accused Nos.3 and 4 are directed to surrender before the Station House Officer, PS, Khazipet, on or before 03.01.2024. Upon such surrender, the said Station House Officer shall release the petitioners/accused Nos.3 and 4 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/accused Nos.3 and 4 shall appear before the concerned police on every Monday between 10am to 12pm for a period of four

(04) weeks and thereafter, as and when required for the purpose of investigation.

3) The petitioners/accused Nos.3 and 4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
