THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.13803 of 2025 ORDER:
The present Criminal Petition is filed praying this Court to grant pre-arrest bail to the petitioners who are arrayed as accused Nos.2 and 4 in Crime No.284 of 2025 before the Nagarkurnool Police Station, Nagarkurnoon District registered for the offence punishable under Section 109 r/w 3(5) of BNS. 2.
The brief facts of the case are that, on 11.08.2025, the de-facto complainant, who is the wife of the injured lodged a report before the police stating that accused Nos.1 to 4 and 6 other unknown persons have attacked on her husband with rods and sticks, therefore, her husband sustained grievous injuries and was admitted into the hospital. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offence.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences, in fact, the sister of the accused No.1 lodged a report before the police against the injured and the police registered a case vide FIR No.283 of 2025 for the offences punishable under Sections 69, 115(2) r/w 3(5) of BNS and this complaint is only a contra blast and there is no overt act against these petitioners. It is further submitted that accused Nos.1 and 3 were already granted regular bail by this Court and there is no pending investigation. Therefore, he prayed the Court to grant prearrest bail to the petitioners by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the alleged offence under Section 109 of BNS is a grievous in nature and the injured sustained grievous injuries and they are not entitled for bail and therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners herein are accused Nos.2 and 4 and as seen from the statement of injured, there is no special case against these petitioners except stating that these petitioners have bet the injured with rods and sticks and further, the accused Nos.1 and 3 were already granted regular bail by this Court. Considering the facts and circumstances of the case, this Court deems it fit to grant prearrest bail to the petitioners, subject to the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Nagarkurnool Police Station, Nagarkurnoon District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail, on their executing a personal bond for Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
