THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14342 of 2024 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused No.6 in Crime No.615 of 2024 of Mancherial Town Police Station, Ramagundem District, on bail, the present Criminal Petition is filed. 2.

The brief facts of the case are that on 24.09.2024, at 00:05 hours, a complaint was filed by Atmakuri Sanjeev, a 28year-old driver, regarding an incident that occurred at Bypass Road, Mancherial.

Sanjeev alleged that accused individuals, instigated by Gadapa Rakesh, criminally entered the house where he was staying, intending to harm him due to a previous grudge related to a Ganesh festival immersion quarrel. The accused allegedly attacked the watchman and a gardener, Abdul Afroz, with knives and rods, causing bleeding injuries, and also attacked Sanjeev with the intention of killing him.

Heard Sri P. Animi Reddy, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon,

learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the allegations leveled against the petitioner are false and baseless, and he had no involvement in the alleged crime. Despite this, the accused were arrested on 01.10.2024, and have been detained since. He asserts that the complainant falsely implicated the petitioner without any specific allegations, and that they were not even present in the village on the date of the incident. The police investigation has been completed, except for the filing of the charge sheet, and the petitioner is willing to furnish security and cooperate with the police. Notably, several co-accused have already been released on bail. The family situation of the petitioner is also precarious, with their father having passed away 17 years ago and their elderly mother requiring care. A previous bail application was dismissed on 20.11.2024, and this is the only pending petition. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor submitted that the petitioner is a habitual offender with a

rowdy sheet opened against him, and five previous cases are pending. The investigation is ongoing, and the charge sheet has not been filed yet. Therefore, the prosecutor urged the Court to dismiss the bail petition.

After considering the submissions made by both the learned counsel and reviewing the material available on record, it appears that that the petitioner has been incarcerated since 01.10.2024, without specific allegations against him. Although a rowdy sheet is pending against the petitioner, the alleged offenses date back to 2018 and 2019, with no subsequent allegations. Given that the material part of the investigation is completed, this Court deems it fit to grant bail to the petitioner with the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Mancherial.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of

investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
