HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.6146 of 2013 ORDER:
This writ petition is filed to declare the action of the 4th respondent in issuing impugned endorsement dated 19.2.2013 in conducting public auction to the petitioners Shop No.94, 74, 71 and 57 respectively of Sri Kasu Brahmannanda Reddy Municipal Shopping Complex, Narasaraopet, as illegal and arbitrary.
The case of the petitioners is that they were declared as highest bidders during the public auction conducted on 2.2.2013 and that they deposited an amount of Rs.50,000/ for their respective shops; without any notice, the impugned endorsement dated 19.2.2013 is given to the petitioners; petitioners filed representation on 11.2.2013 requesting for allotment of shops as they were successful bidders but their representation was not considered till now.
Counter affidavit has been filed by the 4th respondent stating that since single tender has been received by the 4th respondent in respect of allotment of shops, it was decided to conduct a fresh auction. Heard the learned counsel for the petitioners and the learned Standing Counsel for the 4th respondent.
As the representation of the petitioners was not considered, the petitioners are at liberty to file a detailed representation to the 4th
respondent within a period of two weeks from the date of receipt of a copy of this order and the 4th respondent is directed to consider the same and pass orders as within a period of eight weeks from the date of receipt of the representation.
With the above directions, the Writ Petition is disposed of. No order as to costs.
