THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE No.751 of 2017 ORDER:

Heard learned counsel for petitioner and Sri Anand Kumar Kapoor, learned counsel for respondent.

Pursuant to order dt.09-06-2017 passed by this Court in the Contempt Case, the Assistant Director, Survey and Land Records, Visakhapatnam had deputed the Mandal Surveyor, attached to the Office of the Tahsildar, Gajuwaka to determine whether the construction made by the respondent in the Contempt Case falls within the plots claimed by petitioner.

The said Surveyor gave notice to both sides and in the presence of petitioner and representatives of respondent, on the basis of documents produced by either side, came to the conclusion that plot No.22 claimed by petitioner is in the unapproved layout of Brundavan Nagar and did not tally with the boundaries mentioned in Doc.No.7294/1989 produced by petitioner. He also stated that there are no plots or roads on ground as shown in the layout and therefore it is not possible to identify the plot claimed by petitioner. 4.

Having regard to the said finding submitted to this Court vide report dt.06-09-2017 by the Assistant Director, Survey and Land Records, Visakhapatnam, I am of the opinion that no case of willful disobedience or violation of the order passed on 21-05-2015 in

MSR,J C.C.No.751 of 2017 W.P.M.P.No.19287 of 2015 in W.P.No.14834 of 2015 has been made out by petitioner.

Therefore, the Contempt Case is closed. No costs. 6.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
