HON'BLE Smt JUSTICE ANIS CRIMINAL PETITION No.14153 of 2016 ORDER:
This Criminal Petition is filed by the petitioners, under Section 482 Cr.P.C, seeking quashing of investigation in Crime No.172 of 2016 of M.R.Palli Police Station, Tirupati, Chittoor District, registered for the offences punishable under Sections 448, 323, 427 and 506 read with 34 IPC and Section 3(1)(v)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short 'the Act').
Learned counsel for the petitioners contends that the petitioners - A.3 to A.6 are no way concerned with the de facto complainant except having relation with A.1 family; and the petitioners are not concerned with any transactions and have no right over the property in question. Learned Additional Public Prosecutor opposed the Criminal Petition contending that, since the investigation is still going on, the question of quashing investigation does not arise.
In view of the facts and circumstances of the case, I am not inclined to quash the proceedings in the aforesaid crime. However, the petitioners shall surrender before the Special Judge, and file an application for grant of bail, in which event, the learned Judge shall consider and dispose of the
application on its own merits, on the same day or on the next day, in accordance with law.
With the aforesaid observation, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, shall also stand dismissed.
