O R D E R
Heard the counsel for the petitioner and the learned Public Prosecutor for the State.
The petitioner filed a complaint against the respondents 2 to 5 under Section 193 of the Indian Penal Code, which was numbered as C.C.No.309 of 2015 on the file of II Additional Judicial First Class Magistrate at Tanuku, West Godavari District. Now the grievance of the petitioner is that though A-3 - K.Nageswara Rao, has been absconding for the last one year, and there is a direction of this court in Crl.P.No.2677/2015 dated 2.4.2015 to dispose of the case within a period of six months, the learned Magistrate has not been taking any steps for disposal of the case, by considering the petition filed by him under Rule 20 of Criminal Rules of Practice for splitting up the case against A-3 and to proceed against the other accused.
Having regard to the facts and circumstances, the trial court shall first decide whether the case against A-3 can be separated and then take steps permissible under law for expeditious disposal of C.C.No.309 of 2015. The criminal petition is disposed of accordingly. No costs. Miscellaneous petitions pending if any, shall stand closed. --------------------------------- M.S.K.JAISWAL,J DATE:10.06.
