HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION Nos. 2497 & 2589 OF 2011 COMMON ORDER:
Since the issue involved in these two Writ Petitions is one and the same, they are disposed of by this common order. These Writ Petitions came to be filed to declare the action of the respondents in seeking to dispossess the petitioners from their lands in Survey Nos.1333, 1335, 1339, 1385, 1386, 1389, 1390, 1391, 1394, 1395, 1398, 1396 and 1397, situated at West Bapatla, Bapatla(Mandal), Guntur District, as illegal and arbitrary and consequently direct the respondents not to interfere with the petitioners' possession in respect of the said lands. At the time when the matter is taken up for hearing, learned Government Pleader for Revenue filed additional affidavit on behalf of respondent No.4, stating that the lands of the petitioners are not resumed and no steps are being taken, as on today, for their dispossession. It is also stated that no notices were issued by respondent No.4 for dispossessing the petitioners from the aforementioned lands.
In view of the averments made in the additional counter affidavit, no further orders need be passed in these Writ Petitions. It is needless to mention that the respondents shall follow due process of law, before taking any coercive steps against the petitioners in respect of the above mentioned land. Accordingly, both the Writ Petitions are closed. No costs.
