THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13948 OF 2015 ORDER:

This criminal petition under Section 482 of the Code of Criminal Procedure is filed by the petitioner/accused seeking to relax the condition imposed by order dated 14.08.2015, in Crl.M.P.No.1212 of 2015 passed by the Metropolitan Sessions Judge-cum-Special Judge to try Offences under NDPS Act, Visakhapatnam, to the effect that the petitioner shall execute a personal bond for a sum of Rs.10,000/- with two local sureties, of which, one of the surety shall be that of native place of the petitioner.

Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner is poor and is unable to procure the surety amount of Rs.10,000/- and as such, prays this Court to relax the said condition.

Considering the facts and circumstances of the case, the condition stated above is modified to the effect that the petitioner shall execute a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with two sureties, who are from the native place of the petitioner herein.
