Heard Sri V.Narasimha Goud, learned counsel appearing for the petitioner and Sri A.Ravi Babu, learned Standing Counsel for the respondents-Corporation.
2. The father of the petitioner Sri A.Vidyasagar Rao
worked as a driver in the respondents-Corporation for 10 years on regular basis and died in harness on 28-01-2009 leaving the petitioner, his mother and his sister as legal heirs.
The respondents-Corporation offered additional monetary benefits to the petitioner and his family members on the ground that it was not possible to provide him employment on compassionate grounds. The petitioner and his family members did not accept the additional monetary benefits offered by the respondents-Corporation. Some time thereafter, the Government has lifted ban on compassionate appointments vide G.O.Ms.No.2/13 permitting the Corporation in the combined State of Andhra Pradesh to provide employment to the dependants of the deceased employees.
Thereafter, according to the petitioner, he has been requesting the respondentsCorporation for providing him the post of conductor or clerk as he passed B.Com, but, there was no response. Accordingly, he issued a Lawyer's Notice dated 12-6-2015 to the 2nd respondent, which has been received by him on 15-6-2015.
3. The learned counsel appearing for the petitioner submits that a direction be issued to the respondentsCorporation to consider the Legal Notice as representation and take appropriate action regarding the compassionate appointment of the petitioner in the Corporation according to the Rules.
4. On the other hand, the learned Standing Counsel for the respondents-Corporation would submit that the petitioner has to necessarily make a representation regarding the compassionate appointment as there was no representation for compassionate appointment is pending with the Department.
5. Under these circumstances, the writ petition is disposed of directing the petitioner to make a representation to the 2nd respondent seeking compassionate appointment and after the petitioner making such representation, the 2nd respondent is directed to consider the same and pass appropriate orders regarding the compassionate appointment of the petitioner as per the Scheme in the Corporation, according to the Rules within a period of 8 (eight) weeks from the date of receipt of a copy of this order. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
